General terms and conditions of HEMPIKA webshop have been prepared in accordance with the Consumer Protection Act (ZVPot), the law on Personal Data Protection Act (PDPA-1) and the Electronic Communications Act (ZEKom-1).

Terms and conditions govern the operation of an online store Hempika, rights and obligations of the user and the store and govern the business relationship between the company and the customer.
General terms and conditions are also governed by individual purchase rules at the takeover site of Hempika d. o. o..
The buyer is bound by the general terms and conditions valid at the time of the purchase (placing online order).
When placing an order online, the user is notified about the terms and conditions. Each time when a customer places an order, the customer agrees to the general terms and conditions.
Hempika commits that information listed below, will be provided to customer at any time, including before purchase:
company information (name and place of business, registration and VAT number),
contact information, which enables fast and efficient communication (e-mail, phone),
the essential characteristics of products (including after-sales services and guarantees) and the period of validity of this information,
availability of products (each product, which is offered on the site, should be available within a reasonable period of time),
delivery conditions (method, place and time of delivery),
prices must be clearly and unambiguously defined and it must be clear whether they contain taxes, transport costs and/or other charges, and the period of validity of this information,
method of payment and delivery or performance of, and validity of this data,
payment and delivery method,
validity of the offer,
withdrawal period from the contract and conditions for withdrawal (description of the right of withdrawal in accordance with ZVPot 43c; in cases where the customer is in accordance with Article 43c ZVPot no right of withdrawal is expressly informed), interpretation of an appeal, including details of the contact person.
Online store Hempika allows the use to registered and page admin approved users only!
Upon registration, the online store user obtains a user name (e-mail) and password. E-mail address, username and password unambiguously define and connect the registered user to the data input. If a user wants to change e-mail address at any time to another e-mail address it is necessary to send a request to email@example.com.
Protection of personal data
Hempika web store, in accordance with the Law on Personal Data Protection Act (PDPA-1-UPB1)and GDPR, is committed to protecting the personal data of its users.
For business needs Hempika gathers the following information:

Town / City
Password in encrypted form, and other data that users enter into forms on our website.
We are not responsible for the accuracy of the data entered by the users.
For the purposes of ensuring security we also collect IP addresses from which users access the site. Each user is assigned at the beginning of the visit session cookie for identification and monitoring of the shopping cart. Hempika can, among other cookies, store on your computer other things such as the identification number of a user in an encrypted form (to identify the user’s next visit), review articles (that you know which items you already rated) and cookies of Google Analytics (analysis of website visits).
All information, except cookies are stored on the server permanently. Session cookies are stored in server memory only for the duration of the visit and are deleted after one hour of inactivity, permanent cookies are stored on the visitor’s computer.
Managers and page admins can use the data in anonymised summary form for purposes of statistical analysis. Hempika will in no case hand over the users data to unauthorized persons. Delivery service (eg. Post of Slovenia) will be entrusted only with a user’s shipping address and telephone number (if needed).
Data which Hempika collects and processes will be disclosed only if such liability is determined by law or in the good faith belief that such action is necessary for the proceedings before courts or other state authorities as well as to protect and promote the legitimate interests.
Users are also responsible for the protection of personal data in a way that ensures the security of his e-mail address, username and password, and the appropriate software (anti-virus) to protect their computer.
Product offers and prices
Due to the nature of online business, the offer and prices in the Hempika online store are updated and changed frequently. The prices in the online store are not the same for all types of users (retail, white label, bulk, drop shipping and laboratory ). Prices do not include VAT. To users/companies without a valid EU VAT number VAT will be added in the shopping cart.
Prices are valid at the time of the order placement and do not have a predetermined validity.
Prices are valid in the case of payment with the method of payment under the conditions written below.
It may happen that the pricing information is incorrect. In this case, or in the event that the price change appears between the processing the order, Hempika will allow the buyer to cancel the purchase.
Certificates provided by the Laboratory Services
The results of certificates provided by the Laboratory Services given herein apply to the submitted sample only and are not being applicable to the whole batch or variety. The certificate does not substitute any other legal document.
Ordering and prices
The purchase agreement between the seller and the customer in Hempika online store is concluded at the moment Hempika sends the first e-mail to the customer about the status of his order (titled: “Your order is on hold.”). From this moment on, all prices and other terms are fixed and are valid for both the seller (Hempika) and the customer. A customer is a person whose data is indicated when placing the order. Subsequent changing of customer data is not possible. Purchase agreement (i.e., the first e-mail about the status of the order) is electronically stored on the server, and is available to the customer upon written request.
Delivery & shipping
All Hempika’s products are sent directly from Slovenia via Pošta Slovenije or DHL.
Personal pick-up at the company office is also possible at Hempika d.o.o., Rejčeva ulica 5a, SI-5000 Nova Gorica, Slovenia (EU). In the case of personal pick up, there aren’t any delivery costs.
Post of Slovenia & DHL: Calculated at the checkout according to the price list by weight and shipping zone.

Make sure to use your order number as a reference. Note: Although instant in many cases, a bank transfer can take up to 3 days to clear depending on where it is being transferred from. We will start packing your order as soon as your transfer clears.
When confirming the method of payment for the purchase you will receive the invoice to your e-mail address (in .pdf format) immediately after delivery of the package.
The invoice is provided with information about the price and all costs relating to the purchase and with a notice of right to cancel the contract.
The buyer is obliged to check the accuracy of the information before placing an order. Later, given the objections as to the correctness of invoices issued are disregarded.
Hempika always issues a physical receipt copy of an order that is sent inside packaging to the delivery address. The information on the receipt: price and all costs of the delivery, are clearly distinguishable. Customer is obliged to verify the correctness of the data before making the direct bank transfer
1. Choosing a product: Registered and confirmed users can choose the preferred product, choose a quantity and click on the “Add to cart” button. If you want to complete an order, press the “Proceed to checkout” button, that redirects you to the checkout page, where you fill the needed information to complete an order.
2. Deleting a product from cart: Users can see the cart/box icon in the upper right corner. After clicking it, the added products are displayed. If a customer wants to remove undesired product, he or she has to click on the cart icon and when the customer is redirected to cart page, he or she has to click on cross X “remove” or set the number of product to 0 and click on the “Update cart” button to finalize the removal.
3. To users/companies without a valid EU VAT number and Slovenian companies with a valid VAT number VAT will be added in the shopping cart and checkout.
For completing an order, when customer is in cart, the customer has to click “Proceed to checkout”, where customer fills out the required information fields.
1. Delivery address: You are required to fill out all the necessary information regarding delivery, that are marked with star * (name, surname, country, address, post number, e-mail and phone number) and are needed to confirm and complete an order.
2. Delivery cost: Customer can choose between Post of Slovenia and DHL shipping or personal pick-up at the company headquarters.
3. Type of payment: Customer can choose only bank transfer.
4. Order review: Products that are added to cart are displayed on the right side of the site. The customer can view the price of an individual product, delivery cost and total cost, before the customer completes an order.
5. Completing an order: User can review their information about delivery and payment method and the cart content. User confirms the order when “Place order” button is clicked. If order is successfully completed, the message “Thank you. Your order has been received.” will display.
Purchase notification procedure
After completing an order, the customer receives e-mail notification, that the order is accepted. Registered members can view information about status and content of an order in their account.
Hempika can call the customer on their contact telephone number to verify the information or to ensure the accuracy of the delivery status.
Return of goods
We allow companies, sole traders and other legal entities to return items under warranty terms. Legal entities do not have the option of withdrawing from the contract within 14 days or refunding the purchase price, as is the case for final consumers.
Hempika is liable for defects, mistakes and errors that the product had, when danger or defect came to customer, regardless the customer knew about that. Hempika is also liable for other errors, mistakes, defects, that are shown after the danger or defect came to customer, if they are the consequence of a cause that existed before that. Small or insignificant error, mistake or defect is not taken into account.
All products contains natural extracts and therefore the cannabinoid concentrations can vary for batch to batch.
Safety of Data
Hempika uses appropriate technological and organizational means to protect the transmission and storage of personal data and payments.
Communication & electronic advertising messages
Hempika will contact customer through distance communication, but only if customer explicitly agrees. If a customer doesn’t want to receive advertising messages, Hempika is obliged to respect the customer’s decision.
Advertising messages will contain:
Consignor “Hempika” will be clearly evident,
clearly and unambiguously marked as advertising message,
the sender will be clearly visible,
various campaigns, promotions and other marketing techniques will be labeled as such. It will also clearly set out the conditions of participation in them,
process to unsubscribe from receiving ad messages will be clearly defined,
if the customer wishes not to receive advertising messages, Hempika will explicitly respect them.
Reviews, opinions and recommendations
Reviews, ratings and/or recommendations written by buyers, are part of the online store functionality, and are intended for the community of all users.
Hempika allows any user of the online store to write a review, opinion and/or recommendation, but reserves the right to review the comment before approving it and the final publication. Hempika will not publish opinions or contributions that are in any way offensive, inappropriate or which do not, in their judgment, benefit other users and visitors.
Hempika has the right to use the content of a comment for an unlimited time and for any purpose that is in the business interest, including the publication in advertisements or other marketing communications.
At the same time, the author of the opinion declares and ensures that he owns material and moral rights for written opinions and comments, and that these rights are transferred to Hempika in a non-exclusive and unlimited time-bound manner.
All the information on Hempika’s online store, including product images, graphic and video elements on the website are protected and can not be reproduced or used without prior written permission of Hempika’s employees in charge.
Limitation of liability
Hempika is always trying to ensure the up-to-date and correctness of the data published on its websites. Nevertheless, the properties of the articles, the delivery period or the price may change so quickly that sometimes it fails to correct the information on the web pages on time. In such case, Hempika will do their best to notify the customer of the changes and will allow customer to withdraw from the contract or to replace the ordered item.
Exclusion of liability
We reserve the right to disable website or access to it, due to technical or other problems and maintenance or in any other case which Hempika’s admins think is necessary, which means disabling or hindering the use of the online store. In case of technical problems on the website, we reserve the right to cancel orders that were affected by the technical error. If the cancellation occurs, we will try to notify the customer(s) as soon as possible the technical error is detected and inform them with further procedure. The customer must ensure that he/she has the proper protection of the equipment and software before accessing and using the website. Customer is also obliged to provide a reasonable security and privacy of data, that is used for customer login.
Complaints and disputes
Hempika respects the applicable European consumer protection legislation and seeks to fulfill its duty to establish an effective complaint handling system and identify the person with whom, in the event of problems, the customer can connect by telephone or by e-mail.
The complaint is submitted via e-mail firstname.lastname@example.org or via phone +386 68 169 816. The complaint processing procedure is confidential. Hempika will confirm within five working days that it has received a complaint, notify the customer how long it will take to handle it and keep him/her informed about the progress of the procedure.
Hempika is aware that the essential characteristic of the consumer dispute, at least as far as the judicial solution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself.
This is also the main obstacle, that the consumer does not initiate a dispute in front of a court. Because of that, Hempika always strives to do its best to resolve any dispute by mutual consent.
In the case of judicial settlement of disputes, the court shall have jurisdiction in the municipality of the customer.
Out-of-court settlement of consumer disputes
In accordance with the legal norms, we do not acknowledge any contractor for out-of-court settlement of consumer disputes as responsible for resolving a consumer dispute that the consumer could launch in accordance with the Out-of-Court Consumer Dispute Resolution Act. Hempika d.o.o. as a provider of goods and services allows online store in the RS on its website an electronic link to the platform for online dispute resolution for consumer disputes (SRPS). The platform is available to consumers here. That legislation arising from the Act on the out-of-court settlement of customer disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2016/2004 and Directive 2009/22 / EC.
Statement on legal status of products
Hempika does not take any responsibility for damages caused by the delivery, transport and customs clearance of ordered items. Customer agrees, that he/she inquired up-to-date and official information about the legal status of the products ordered in the country where the customer is ordering from.
Hempika does not have documents that would explicitly explain the legal status of products in certain countries.
